1. Acceptance of Terms
By accessing or using WaveCheck, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. About WaveCheck & Eligibility
WaveCheck is a surf condition reporting platform. Its primary purpose is enabling surfers to share real-time wave, weather, and ocean condition reports with each other.
WaveCheck is not a social media service. While the platform includes community features such as likes, follows, and shares, these exist solely to surface the most accurate surf reports and help users build trusted reporter networks. There are no direct messages, comments, or social feeds unrelated to surf conditions.
You must be at least 16 years old to create an account on WaveCheck. By creating an account, you confirm that you meet this age requirement. If we become aware that an account belongs to someone under 16, we will remove it.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating an account.
4. User Content
You retain ownership of content you post on WaveCheck. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within our platform.
5. Prohibited Conduct
WaveCheck is a surf-only content platform. All photos and videos uploaded must be directly related to surfing, ocean conditions, or surf culture. Non-surf-related content is strictly prohibited.
The following content is expressly forbidden and subject to zero-tolerance enforcement: nudity or sexually explicit material, drug use or drug-related content, graphic violence, illegal activity, hate speech, and any other content unrelated to surfing.
Premium subscription status does not exempt users from these rules. All users, regardless of account type, are held to the same content standards.
We encourage users to report content that violates our guidelines, since verified reports help keep the community safe and are rewarded with points. However, submitting false or malicious reports to manipulate the platform (such as reporting legitimate posts to trigger their removal) is strictly prohibited. Users found submitting fake reports may lose points at an increased penalty rate and may face account suspension.
6. Points, Rewards & Fair Use
Points and rewards must be earned through genuine, legitimate use of the platform. Any attempt to exploit, manipulate, or game the points system is strictly prohibited.
Prohibited activities include, but are not limited to: exploiting bugs or technical glitches to earn points, creating duplicate or fake accounts, using automated tools or bots, colluding with other users, and any other behavior intended to unfairly accumulate points or rewards.
WaveCheck reserves the right, at its sole discretion, to determine what constitutes abuse or exploitation of the points system. We may adjust, void, or revoke points and rewards, withhold redemptions, and suspend or permanently ban accounts engaged in abusive behavior, without prior notice or compensation.
WaveCheck reserves the right to modify the points system, earning rates, rewards, and redemption rules at any time without prior notice.
7. Premium Subscription
WaveCheck offers an optional Premium subscription. Subscriptions are billed through your Apple ID or Google Play account at the price and billing period shown at the point of purchase. Unless cancelled at least 24 hours before the end of the current period, subscriptions automatically renew at the same price.
You can cancel at any time through your Apple ID or Google Play account settings. Cancellation takes effect at the end of the current billing period, and you will retain Premium access until then. Refunds for App Store and Google Play subscriptions are handled by Apple or Google in accordance with their policies, not by WaveCheck.
Subscription pricing, features, and benefits may change at any time. We will provide reasonable notice of any material changes that take effect during an active billing period.
8. Termination
We reserve the right to suspend or permanently ban your account at any time for violations of these terms or for any other reason at our discretion.
Proven violations of our content policy (including but not limited to posting nudity, drug-related content, violence, or illegal activity) will result in an immediate and permanent account ban. Premium users who are banned for content policy violations will not receive refunds for any remaining subscription period.
9. Disclaimer of Liability for User Content
WaveCheck is not responsible for content posted by its users. Users are solely responsible for the content they upload, share, or distribute through the platform.
WaveCheck employs automated content detection systems and community reporting tools, and will take all reasonable measures to detect, block, and remove prohibited content and ban offending accounts. However, we cannot guarantee that all violations will be caught immediately.
10. Disclaimer of Warranties
WaveCheck is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted or error-free, or that the surf condition reports posted by users will be accurate. Surf reports reflect the observations of individual users and should not be relied upon as the sole basis for decisions about ocean safety. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.
11. Limitation of Liability
To the maximum extent permitted by law, WaveCheck and its operators will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including loss of data, loss of profits, or any injury, loss, or damage arising from your participation in surfing or ocean activities, whether or not based on information obtained through the service. Our total liability for any claim related to the service is limited to the amount you have paid us in the twelve months preceding the claim, or AU$100, whichever is greater. Nothing in this clause limits any liability that cannot be limited under the Australian Consumer Law.
12. Governing Law and Disputes
These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or your use of WaveCheck will be resolved in the courts of Queensland, and you agree to submit to the exclusive jurisdiction of those courts.
13. Changes to Terms
We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the new terms.
